Aqua Stacks Terms of Service

IMPORTANT: PLEASE READ CAREFULLY

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between Kodrivo ("Company", "we", "our") and you ("User", "you", "your") who uses the Aqua Stacks mobile application ("App", "Game", "Service").

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

If you do not agree to these terms, do not use the application.

1. DEFINITIONS

1.1 "Application" or "Game": Aqua Stacks mobile application and all its components

1.2 "Service": All features provided through the Application

1.3 "Content": All graphics, sounds, texts, and code within the game

1.4 "Virtual Items": In-game currency, cards, and other digital content

1.5 "User Data": Your game progress and preferences

2. LICENSE AND USAGE RIGHTS

2.1 License Grant

Subject to your compliance with these Terms, we grant you a:

• Limited
• Non-exclusive
• Non-transferable
• Revocable
• Worldwide

license to use the application solely for personal, non-commercial purposes.

2.2 License Restrictions

You agree NOT to engage in the following activities:

Technical Restrictions:

• Reverse engineering, source code extraction, or decompiling the application
• Modifying, adapting, or creating derivative works
• Bypassing, disabling, or circumventing security measures
• Using automated tools, bots, scripts, or cheat software
• Gaining unauthorized access to the application's servers

Commercial Restrictions:

• Selling, renting, or licensing the application or any part thereof
• Using the application for commercial purposes
• Copying or distributing application content without permission

Behavioral Restrictions:

• Using the application in a manner harmful to other users
• Using for illegal purposes
• Using in a way that damages the application's reputation

2.3 Rights Reserved

All rights not expressly granted in these Terms are reserved by Kodrivo.

3. INTELLECTUAL PROPERTY RIGHTS

3.1 Company Ownership

All intellectual property rights, including but not limited to the following, belong exclusively to Kodrivo:

• Application source code and software
• Graphic designs, icons, and visual elements
• Sound effects and music
• Game mechanics and algorithms
• "Aqua Stacks" name and logo
• User interface design
• All texts and content

3.2 Copyright Notice

The application and its content are protected by Turkish Republic and international copyright laws, the Bern Convention, and other intellectual property laws.

3.3 Trademarks

"Aqua Stacks", "Kodrivo", and related logos are registered or unregistered trademarks of Kodrivo.

4. USER CONDUCT RULES

4.1 General Rules

When using the application, you agree to comply with the following rules:

• Comply with all applicable local, national, and international laws
• Respect other users' rights
• Play honestly and fairly
• Not provide misleading or false information

4.2 Prohibited Behavior

The following behaviors are STRICTLY PROHIBITED:

Cheating and Manipulation:

• Using cheat software, bots, or automated tools
• Manipulating game data
• Exploiting bugs
• Account sharing or selling

Malicious Activities:

• Distributing viruses, trojans, or malware
• Conducting DDoS or similar attacks
• Collecting or stealing user data

5. IN-APP PURCHASES

5.1 Virtual Items

The application may contain purchasable virtual items:

• In-game currency (tokens/coins)
• Power cards
• Cosmetic items
• Other digital content

5.2 Purchase Terms

• All purchases are FINAL and NON-REFUNDABLE
• Purchased items remain Kodrivo's property
• A license to use the items is granted; ownership is not transferred
• Virtual items have NO REAL-WORLD VALUE
• Virtual items cannot be converted to cash or transferred

5.3 Payment Transactions

• All payments are processed through Apple App Store or Google Play
• Payment terms are subject to the respective store's conditions
• Kodrivo does not directly process or store your payment information

5.4 Refund Policy

• Digital content sales are generally non-refundable
• Technical issue-related requests should be directed to support@kodrivo.com
• Store refund policies take precedence

5.5 Price Changes

Kodrivo reserves the right to change virtual item prices without prior notice.

6. ADVERTISEMENTS

6.1 Ad Content

The application contains advertisements through Google AdMob:

• Banner ads
• Interstitial ads
• Rewarded video ads

6.2 Disclaimer

• Ad content belongs to third parties
• Kodrivo is NOT RESPONSIBLE for the accuracy of ad content
• Transactions with advertisers are your responsibility

7. LIMITATION OF LIABILITY AND WARRANTY DISCLAIMER

7.1 "AS IS" PROVISION

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE". KODRIVO MAKES NO EXPRESS OR IMPLIED WARRANTIES.

THE FOLLOWING WARRANTIES ARE SPECIFICALLY DISCLAIMED:

• Merchantability warranty
• Fitness for a particular purpose warranty
• Non-infringement warranty
• Uninterrupted or error-free operation warranty

7.2 Limitation of Liability

KODRIVO SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR:

Indirect Damages:

• Loss of profits
• Loss of data
• Business interruption
• Loss of reputation
• Indirect, incidental, special, or punitive damages

Technical Issues:

• Server outages
• Connection problems
• Software errors
• Device incompatibilities

Third-Party Actions:

• Advertiser actions
• Store transactions
• Other user actions

7.3 Maximum Liability

KODRIVO'S TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE AMOUNT YOU PAID FOR THE APPLICATION IN THE LAST 12 MONTHS. IF YOU MADE NO PAYMENT, LIABILITY IS ZERO.

7.4 Mandatory Rights

Some jurisdictions do not allow exclusion of certain warranties. In such cases, the above limitations apply to the minimum extent permitted by law.

8. INDEMNIFICATION

You agree to INDEMNIFY Kodrivo, its directors, employees, and affiliates against all claims, lawsuits, damages, losses, and expenses (including attorney fees) arising from violation of these Terms, your negligence, or misuse.

9. SERVICE CHANGES AND TERMINATION

9.1 Right to Change

Kodrivo may at any time and WITHOUT PRIOR NOTICE:

• Update the application
• Add or remove features
• Change prices
• Reduce service scope

9.2 Service Suspension / Termination

Kodrivo may at any time:

• Temporarily suspend the service
• Permanently terminate the service
• Discontinue service in certain regions

9.3 Account Termination

Your account may be terminated WITHOUT PRIOR NOTICE in the following cases:

• Violation of these Terms
• Suspected illegal activity
• Cheating or manipulation
• Harming other users
• Extended inactivity

9.4 Termination Consequences

Upon account termination:

• All virtual items and progress are lost
• You cannot claim refunds or compensation
• You may be prevented from creating new accounts

10. DISPUTE RESOLUTION

10.1 Governing Law

These Terms are governed by the laws of the REPUBLIC OF TURKEY.

10.2 Jurisdiction

For all disputes arising from these Terms, IZMIR COURTS and ENFORCEMENT OFFICES have exclusive jurisdiction.

10.3 Mediation

Parties will attempt to resolve disputes amicably before filing a lawsuit. The right to apply to Consumer Arbitration Committees is reserved for consumer transactions.

10.4 Class Action Waiver

TO THE EXTENT PERMITTED BY YOUR JURISDICTION, YOU WAIVE YOUR RIGHT TO BRING ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION.

11. FORCE MAJEURE

Kodrivo SHALL NOT BE LIABLE for failure to perform its obligations due to events beyond its control:

• Natural disasters
• War, terrorism, civil unrest
• Pandemic or epidemic
• Government actions, legal changes
• Infrastructure failures, internet outages
• Cyber attacks

12. SEVERABILITY

If any provision of these Terms is found invalid, illegal, or unenforceable:

• The provision in question shall be severed to the minimum extent
• Other provisions shall remain in full force and effect

13. WAIVER

Kodrivo's failure to exercise or delay in exercising any right does NOT constitute a WAIVER of that right.

14. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and other related policies, constitute the ENTIRE AGREEMENT between the parties and supersede all prior agreements.

15. CHANGES

15.1 Right to Change

We reserve the right to change these Terms at any time.

15.2 Notification

Significant changes will be:

• Notified through the application
• Marked with new date and version number

15.3 Acceptance

Your continued use of the application after changes means you ACCEPT THE NEW TERMS.

17. SPECIAL PROVISIONS

17.1 Consumer Rights (Turkey)

Your rights under Law No. 6502 on Consumer Protection are reserved.

17.2 EU Users

If you reside in the EU, your mandatory rights under EU consumer protection laws cannot be limited by these Terms.

17.3 California Users

California users have the following information pursuant to California Civil Code Section 1789.3:
